TERMS AND CONDITIONS OF SALE
By purchasing or ordering Goods from e-burn, you agree to be bound by the terms and conditions set out below. Before placing your order, if you have any questions relating to these Conditions, please contact us at customerservices@e-burn.com.

1. Definitions

“e-burn” / “Us” / “Our” means E-Burn Limited, a company registered in England and Wales. Registered office: Unit 3, Swordfish Way, Sherburn In Elmet, Leeds, LS25 6NG.

“Conditions” means these terms and conditions.

“Goods” means any single-use e-burn products or accessories you purchase.

“Personal Information” means the details provided by you for order fulfilment and age verification.

“Website” means www.e-burn.com – www.switchtoquit.com – www.eburn.co.uk

“You/Your” means the person or business entity ordering the Goods.

2. Quality and Product Life

2.1. Manufacture: E-Burn single-use products are manufactured under licence and individually tested. Products are supplied fully charged.

2.2. Shelf Life: Products should be used within twelve months of manufacture. We suggest stockists rotate stock to ensure sale within six months of purchase.

2.3. Identifying Age: The manufacture date is embedded in the unique ID number on the battery.

Example: ID eb 5042315853. Digits 2 & 3 (04) indicate the month; digits 4 & 5 (23) indicate the year (April 2023).

2.4. Storage: Goods must be stored at room temperature, stored horizontally, effectively rotated, and kept out of direct sunlight or extreme conditions.

3. Orders and Eligibility

3.1. Age Restriction: Goods are only available to individuals aged 18 years or over. By placing an order, you confirm you meet this legal age requirement. We will use your Personal Information to conduct mandatory age verification.

3.2. Territory Restrictions: e-burn Ltd explicitly prohibits online sales outside the United Kingdom. We do not ship to the United States or the Netherlands under any circumstances. Orders placed for delivery outside the UK will be cancelled.

3.3. Contract: The contract is formed only when we despatch the Goods. An automated order acknowledgement does not constitute legal acceptance of your order.

3.4. Flavours: Once supplied in accordance with a purchase order, we are unable to exchange products for alternative flavours.

4. Price and Payment

4.1. Payment: Payment must be made via the Website. Goods will be despatched only upon receipt of cleared funds.

4.2. Trade Accounts: Approved trade customers may benefit from a 30-day account facility. Payment is due within 30 days of the electronic PDF invoice date.

4.3. Bulk Orders: Customers may pay in advance for “Bulk Call-Off” orders to secure lower pricing. These must be delivered to a single delivery address.

5. Delivery and Risk

5.1. No Safe Place: Due to the nicotine content of the Goods, all deliveries require mandatory age verification upon receipt. Goods cannot be left in a safe place, porch, or with a minor.

5.2. Couriers: We utilise Royal Mail (Tracked 48) and DHL. Selection is made at checkout. Orders over £30 qualify for free shipping via Royal Mail.

5.3. Ownership: Risk of damage passes to you upon delivery. However, ownership of the Goods does not pass to you until we have received payment in full.

6. Cancellation and Returns

6.1. Change of Mind: Due to health, safety, and hygiene reasons regarding nicotine products, we do not operate a “sale or return” service. We cannot accept returns of unwanted or tampered goods as we cannot verify product integrity for redistribution.

6.2. Faulty Goods: Any product which does not operate correctly must be reported immediately to customerservices@e-burn.com.

6.3. Returns Process: A returns form will be issued. Any product found to be faulty, less than 6 months old, and showing no signs of tampering will be replaced free of charge. Testing typically takes 7–10 days.

6.4. Pre-Shipment: If a refund is requested before the Goods have been despatched, a full refund will be processed.

7. Recycling Programme

7.1. Collection: We offer paid recycling collection in mainland England and Wales. Charges apply upon collection.

7.2. Requirements: Boxes must remain sealed with security tags, be at least 75% full, and contain only E-Burn products.

7.3. Non-Compliance: Boxes containing third-party products or those less than 75% full will incur carriage charges. Contaminated boxes will be returned at the sender’s expense.

8. Limitation of Liability

8.1. We will not be liable for any loss or damage that is not reasonably foreseeable, nor for losses related to business interruption or lost profits for trade customers.

8.2. Nothing in these Conditions limits your statutory rights as a consumer under UK law.

9. Privacy and Data

9.1. We process your Personal Information to fulfil orders and satisfy legal age-verification requirements.
